Club Coop Terms of Service

These Terms of Service constitute a legally binding agreement between you and Club Coop Inc., a Delaware corporation (together with its affiliates, “Club Coop”, “we,” “our” or “us”) governing your use of our products, services, software, platform and websites (collectively, the “Services”).

YOU ACKNOWLEDGE AND AGREE THAT, BY CLICKING ON THE “I AGREE” OR SIMILAR BUTTON, REGISTERING FOR AN ACCOUNT, DOWNLOADING ANY SOFTWARE OR UPGRADES, OR ACCESSING OR USING THE SERVICES, YOU ARE INDICATING THAT YOU HAVE READ, UNDERSTAND AND AGREE TO BE BOUND BY THESE TERMS OF SERVICE, WHETHER OR NOT YOU HAVE REGISTERED WITH THE SITE OR APP. IF YOU DO NOT AGREE TO THESE TERMS OF SERVICE, THEN YOU HAVE NO RIGHT TO ACCESS OR USE THE SERVICES. These Terms of Service are effective as of the date you first click “I agree” (or similar button or checkbox) or use or access the Services, whichever is earlier.

If you accept or agree to these Terms of Service on behalf of your employer or another legal entity, you represent and warrant that (i) you have full legal authority to bind your employer or such entity to these Terms of Services; (ii) you have read and understand these Terms of Service; and (iii) you agree to these Terms of Service on behalf of the party that you represent and any permitted users of such party. In such an event, “you” and “your” will refer and apply to your employer or such other legal entity.

Any personal data you submit to us or which we collect about you is governed by our Privacy Policy (“Privacy Policy”). You acknowledge that by using the Services, you have reviewed the Privacy Policy. The Privacy Policy is incorporated by reference into these Terms of Service and together form and are hereinafter referred to as this “Agreement.”

PLEASE NOTE: THIS AGREEMENT GOVERNS HOW DISPUTES BETWEEN YOU AND CLUB COOP CAN BE RESOLVED. IT CONTAINS A BINDING AND FINAL ARBITRATION PROVISION AND CLASS ACTION WAIVER (SECTION 14). PLEASE READ CAREFULLY AS IT AFFECTS YOUR LEGAL RIGHTS, INCLUDING, IF APPLICABLE, YOUR RIGHT TO OPT OUT OF ARBITRATION.

1. License Grant and Restrictions

Subject to your compliance with these Terms of Service, Club Coop Inc. grants you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to download, access, and use the Club Coop app and related services solely for your personal, non-commercial use.

You may not:

• Rent, lease, sublicense, sell, transfer, assign, redistribute, or otherwise commercially exploit the app or any part of the services;
• Copy, modify, adapt, translate, reverse engineer, decompile, disassemble, or attempt to discover the source code of the app or any part of the services;
• Scrape, collect, copy, or download any data, deals, or content from Club Coop except as expressly permitted by the app’s features;
• Use the services in any way that violates applicable law or the rights of others;
• Circumvent or attempt to circumvent any security measures or restrictions in the app or services.

All rights not expressly granted to you are reserved by Club Coop Inc.

2. App Store and Platform Terms

If you download or access the Club Coop app via a third-party platform or app store (such as Apple App Store or Google Play), your use of the app is also governed by the applicable terms and policies of that platform. Club Coop Inc. is not responsible for any obligations or warranties required by those platforms. In the event of any conflict between these Terms of Service and the terms of the app store or platform provider, the platform provider’s terms will govern with respect to your use of the app on that platform.

The respective platform providers (e.g., Apple, Google) are not responsible for maintenance, support, warranty, or addressing claims related to the Club Coop app.
